Platform Use Agreement
By accessing or using Fish Roulette, you agree to comply with our platform guidelines, community standards, and all applicable laws and regulations. Users are responsible for providing accurate profile information and adhering to all local, state, and federal fishing regulations. Failure to comply may result in account suspension or termination without notice.
Liability & Risk Acknowledgment
Fish Roulette serves solely as a platform connecting captains and co-anglers and assumes no responsibility or liability for any personal injury, property damage, accidents, or other incidents occurring during fishing trips. Users acknowledge and accept all inherent risks involved in fishing activities and agree to hold Fish Roulette harmless from any claims, losses, damages, or legal actions arising from their use of the platform or participation in fishing activities.
Captain Obligations
Captains are solely responsible for maintaining valid licenses, complying with all applicable fishing laws and regulations, and ensuring the presence of appropriate safety equipment on their vessel. Fish Roulette does not provide any form of insurance coverage for users or captains. Captains agree to indemnify and hold Fish Roulette harmless from any liability, claims, or legal disputes resulting from their operation or services.
Payment Terms
Fish Roulette utilizes a flat-rate model of approximately $20 per trip, processed through Stripe. Payments are held in escrow until 48 hours after trip completion, allowing time for dispute resolution if necessary. Users agree that Fish Roulette may deduct platform fees and any applicable taxes prior to disbursement of funds. In case of disputes, Fish Roulette reserves the right to withhold or refund payments at its sole discretion.
Dispute Resolution
All disputes or claims arising from or related to the use of Fish Roulette must first be addressed through the platform's internal communication channels. Users agree to attempt good-faith resolution before pursuing any legal action. Should any dispute persist, the parties agree to binding arbitration in the state of Fish Roulette's incorporation, waiving their right to a jury trial or class action.
Insurance Disclaimer
Fish Roulette does not provide any insurance coverage for users, captains, or fishing activities. Users are solely responsible for obtaining their own insurance coverage where necessary. Captains must disclose any relevant insurance information to co-anglers upon request. Fish Roulette disclaims all liability arising from the absence or inadequacy of insurance coverage.
Platform Modification & Termination
Fish Roulette reserves the right to modify, suspend, or terminate platform services at any time without prior notice. We may update these Terms and Conditions periodically, and continued use of the platform signifies acceptance of any updated terms. Users may discontinue platform use if they do not agree to any changes.
Governing Law & Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the state of Fish Roulette's incorporation. Any legal disputes shall be resolved exclusively in the courts of that state. Users waive any objections to the jurisdiction of such courts.
